WAGE LOSS BENEFITS FROM MINNESOTA FAMILY AND MEDICAL LEAVE ACT.
The Minnesota Family and Medical Leave Act (FMLA) provides protection to injury victims with disabilities that prevent them from working. Minnesota employers, like employers in virtually every state of the union, must follow the federal family and medical leave act, which allows eligible employees to take unpaid leave for certain reasons. Further, once the employee’s FMLA leave it is over, the employee may have the right to be reinstated to his or her former work position.
Minnesota employees who are eligible under the act may take up to 12 weeks of leave for serious medical conditions, including those resulting from injury due to car accidents, work related injuries, and other types of injuries for which Minnesota law provides compensation.
Employees of Minnesota are subject to the front FMLA if they are employed by an employer with at least 50 employees and have been employed for at least 20 weeks in the past or current year. Employees are eligible for FMLA leave. If they have worked for the company for at least a year, if they have worked at least 1250 hours during the previous year, and if they have worked at a location with at least 50 employees within a 75 mile radius.
FMLA leave is available if an employee needs time off to recuperate from a serious health condition or to care for a family member who suffered serious injury during active duty in the military.
Minnesota employees are entitled to 12 weeks of leave in a 12 month. Period. Leave is available every 12 months, as long as the employee continues to meet the eligibility requirements of the Act.
CAR ACCIDENT WAGE LOSS BENEFITS FROM NO FAULT INSURANCE.
Under Minnesota's No Fault Insurance Act, the victims of personal injury in car accidents are entitled to wage and earnings loss benefits from No Fault Insurance when those losses are the result of injuries sustained in a car accident.
